administrator and the
referenced litigation can

Letter
to the Editor,
On
6-05-02, the Shady Cove
city administrator posted
a single line letter to
the undersigned.
Quote: Since there
is litigation pending,
all communication to the
City should be addressed
through your attorney,
(Name
Withheld).
Whether this letter
passes a Constitutional
test may be addressed in
federal court including
definition of all
communication.
In one sentence on
letterhead, the city
revoked police
protection, electorate
interface, and all else
afforded under the
Constitutions First
and Fourteenth
Amendments.
To
test Shady Coves
order, at 9:45 AM on
7-02-02, (two days before
annual celebration of our
freedom and Constitution)
I entered the Shady Cove
city hall with my sewer
bill and payment in
hand. It was
cordially accepted and
receipt provided.
The police were not
called nor was I ordered
out for violating a
direct written order by
exercising
communication
with a tyrannical city
government.
City
hall failed this test for
several reasons: The city
overstepped executive
powers granted any city
by revoking
Constitutional rights, a
power not afforded even
our federal judiciary;
The city tripped over its
own enthusiasm in a blind
rush to harass,
intimidate and promote
fear; The city never
imagined any citizen
could not be terrorized
into passivity and
silence. Proven
was; when Shady Cove
attempts revocation of
Constitutional rights for
disagreement, it retains
the right to collect fees
and taxes.
This
example of tyranny caused
questions amongst my
peers. Would anyone
cited for violation of
traffic law or ordinance
that then pleads
not guilty
experience revocation
of
communication
with the City of Shady
Cove until the matter is
settled in municipal
court? We would
anticipate the city
reciprocating while
litigation is
pending by not
communicating
with the offender thereby
sacrificing its powers,
tax collection,
etc. A dictatorship
wouldnt apply this
balance of justice.
