Mr.
Mayor,
You
will recall that I
brought questions before
the council on June 7,
2001 concerning the above
references. After
contacting organizations
in hope to obtain the
information you refused
to furnish and after your
strong admonishment
during the July 19, 2001
council meeting, the
subject of obtaining the
documents was temporarily
shelved.
To
quote a portion,
And the advise we
received from the city
attorney is, it is very
defendable and if there
is a group of citizens
who are unhappy, they can
have their attorney
contact the citys
attorney.And thats
our position on
that.
You
surely recall that on
April 21, 2002 during a
legal proceeding, in an
apparent change about
public document
availability, you
attested that such public
information was available
in a reasonable time
frame and seemingly
without having to go
through attorneys. I
recall that three days
was mentioned. Because
the council is again
considering a police
levy, the time now seems
most appropriate for me
to again request copies
of those documents from
the State Department of
Revenue, the City
Accountant (C.P.A.?), and
the City Attorney who
supported the revision of
the levy wording as
revised by Ordinance 183.
In
the interest of fairness
and ultimate economy to
the city, I will wait ten
working days from the
city receipt of this
letter before proceeding
with other avenues to
obtain the documents you
have sworn as available
to the public.
